The company with the trade name “COSMOTE – MOBILE TELECOMMUNICATION SOCIÉTÉ ANONYME” (hereinafter “COSMOTE”) and the company with the trade name “COSMOTE Payments – E-MONEY SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME” (hereinafter “COSMOTE Payments”), both seated in Marousi, Attica, at 99 Kifissias Avenue, (hereinafter the “Organisers”) are jointly organising a promotional action titled “Pay via payzy and win double the data” (hereinafter the “”). The purpose of these terms (hereinafter the “Terms”) is to define the terms of participation in the Offer.
1. The offer’s starting date is 20/11/2023 & COSMOTE Payments reserves the right to stop the promotional action without prior notification of the User.
2. The Offer is available to COSMOTE Neo subscribers 18 years or older who pay their monthly plan via standing order and who have an active plan (i.e. no more than 31 days have passed since the previous successful payment). A subscriber wishing to participate (hereinafter the “Participant”) in the Offer should pay their monthly plan within the above period via virtual or physical payzy VISA debit card (hereinafter the “card”) on the COSMOTE application (hereinafter the “Application”).
3. Participants activating a standing order via Card will receive free GB to use until the next planned payment. The combinations participating in the Order and giving Participants the corresponding free GB are the following:
4. The Offer is valid only for payments made within the period defined in paragraph 1 above.
5. Terms of use of the free GB data packages Participants receive:
a) The free GB are valid until the next planned payment. If the plan remains active after the end of this period, the duration of the free GB is extended once more for an additional 31 days. As such, each plan or free GB may be used for a maximum of 62 days.
b) Subscribers may change their plans at any time, with changes and corresponding changes to free GB coming into force starting from the next planned payment.
c) Free GB may not be used while roaming.
6. For directly available free GB, Participants will receive notification via SMS regarding the activation of the gift.
7. In case the standing order cannot be processed due to the fault of the Subscriber (e.g. expired card, rejection by COSMOTE Payments), the Subscriber shall receive notification via SMS and through the Application and will not receive the free GB. The standing order and plan will be deactivated if the transaction is not completed within 5 calendar days. Subscribers can reactivate their plans by selecting a combination of speaking time, MB (and optionally SMS) and establishing a standing order, just like the initial activation. Subscribers paying their monthly plan via Card within the Offer period as defined in paragraph 1 will receive free GB as defined in the table in paragraph 4.
8. The free GB are Subscriber-specific and may not be transferred, traded, replaced with other benefits or exchanged for money.
9. Participants may participate in the Offer more than once (1) throughout the Offer period, receiving free GB every time they pay their monthly charges through the COSMOTE application using their Card.
10. The COSMOTE Neo plan is offered in accordance with the terms posted at https://www.cosmote.gr/pdf/oroi-xrisis-cosmote-neo.pdf, the GENERAL COSMOTE Mobile Telephony Terms, the applicable price list for the plan and the terms of the COSMOTE application (hereinafter the “Application”). The use of the Card is subject to the policy and pending its approval by COSMOTE Payments.
11. The company with the trade name “COSMOTE” is the data controller.
The following personal data are collected for participation in the Offer:
- Participant’s name and surname
- Mobile Phone Number
- Choice of monthly plan (GB, speaking time and SMS)
- Date and time of monthly payment plan (GB, speaking time and SMS)
- Customer Card Details
- Total payment amount
Data is collected for the purpose of organising the Offer, publicity requirements according to these Terms, and distributing the gifts. The data is retained according to the periods stated on the web page https://www.cosmote.gr/cs/cosmote/gr/dataprivacypolicy.html, unless otherwise specified by law.
More specifically, in case of a dispute or complaint regarding the Offer, the data may be stored until final resolution of the dispute.
At the end of the above period, the data will be erased in a manner that makes recovery technically infeasible.
“COSMOTE” shall refrain from processing participants’ personal data for purposes other than those stated above. “COSMOTE” must inform Participants and receive their clear, express consent to use the data for other purposes.
“COSMOTE” does not process or disclose personal data to third parties, with the exception of cases where their communication/transmission is required by the applicable legislation.
Participants have the following rights regarding the processing of their personal data:
- The right of access, i.e. the right to receive information about the personal data subject to processing (e.g. the purposes of processing, the types of data, the recipients to whom they are communicated, the period for which they are retained) and to be provided copies thereof.
- The right to rectification, i.e. the right to request the rectification of their data (e.g. rectification of contact details).
- The right to erasure, i.e. the right to request the erasure of their personal data if they are no longer necessary in relation to the purposes for which they were processed or if they withdraw their consent.
- The right to restriction of processing, i.e. the right to request the restriction of processing for a specific purpose.
- The right to object to processing, i.e. the right to object to the processing of their personal data.
“COSMOTE” has appointed a Data Protection Officer (DPO) based on the provisions of the applicable legislation. To contact the Data Protection Officer, Participants may send an e-mail to customerprivacy@cosmote.gr.
In order to exercise their rights, Participants may send an e-mail to customercare@cosmote.gr or a fax to 2102511888, to the address COSMOTE Customer Service, Department of Customer Service, P.O. Box 61168, 15110 Marousi, titled
“Exercise of Personal Data Rights”, accompanied by a copy of their identity card and stating their full name.
Participants retain the right to lodge a complaint, via a special web portal, with the Hellenic Data Protection Authority (Athens, 1-3 Kifissias Avenue, P.C. 115 23 | tel: +30 210 6475600). Detailed instructions for submitting a complaint are provided on the Authority’s website.
“COSMOTE” shall respond to Participants’ requests free of charge without delay, within one (1) month from the receipt of the request. In exceptional cases, this deadline may be extended by two (2) months if the complexity of the request so requires. In any case, notification shall be made regarding this extension and the reason for the delay.
If it is found that the request is clearly unfounded or excessive, the Organisers reserve the right to request payment of a reasonable fee for their satisfaction, taking into account the administrative costs for its execution, or even to refuse to follow up the request.
“COSMOTE” shall take appropriate organisational and technical measures to secure the data and protect them from accidental or unlawful destruction, accidental loss, alteration, prohibited dissemination or access, or any other form of unlawful processing.
“COSMOTE” shall not be liable for leaks of the Participants’ personal data due to their disclosure of any of their data via third-party or other internet sites.
“COSMOTE” does not possess the right to access, control or process participants’ data and content, except in the cases referred to in the terms of the Offer. By way of exception, authorised employees or third-party associates of the Organisers may be granted access to the data, upon a request to the Participants and their express consent, to resolve technical issues or provide technical support for the Offer. Said employees or third-party associates shall be informed of their obligation of confidentiality and are bound to maintain said confidentiality and protect the personal data.
These Terms regarding participation in the Offer shall continue to bind Participants even after its expiry and for as long as the right of access to the content is retained, in accordance with the above.
12. The Organisers retain the right to unilaterally amend these terms or even to cancel or extend the duration of the Offer. Any such amendment will enter into force upon posting to the websites of the Organisers, COSMOTE (cosmote.gr) and COSMOTE Payments (payzy.gr). Said terms will always be available on the websites and kept up to date. Any such amendments shall be binding on all Participants. The Organisers shall bear no liability towards the Participants and/or any third party for any direct or indirect damages, costs or expenses that may arise from any such amendment.
13. Each Participant shall be exclusively responsible for the veracity, accuracy, completeness and correctness of the information they submit. In cases where Participants submit incomplete or inaccurate information, the Organisers retain the right throughout the Offer and after the expiry thereof to exclude said Participants from the process, even at the gift stage, without any claim or demand by the Participant.
14. Participation in the Offer requires and implies the explicit and unreserved acceptance of all these Terms.
15. These Terms are governed by Greek law and any dispute arising from the Offer shall be settled before the materially competent courts of Athens.
