The societe anonyme with the corporate name “COSMOTE PAYMENTS – E-MONEY SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME” (hereinafter “COSMOTE Payments” or “Organiser”) with registered offices in Marousi, Attica (99 Kifissias Ave.), is organising a promotional action titled “WHAT’S UP Students - 10€ coupon” (hereinafter “Promo”). Through this campaign, subscribers to the prepaid mobile program "What’s Up Student" of "HELLENIC TELECOMMUNICATIONS ORGANIZATION S.A." (hereinafter "OTE") are rewarded with a 10€ coupon (hereinafter "Coupon") if they complete their registration in the "payzy by COSMOTE" Application (hereinafter "App") within a specified period.
The purpose of these terms (hereinafter “Terms”) is to define the terms of participation in the Promo.
1. All residents of Greece who are legally competent, have reached the age of 18, are students, and are subscribers to the “What’s Up Student” prepaid program by OTE, and who have not yet registered in the App, are eligible to participate in the Promotion (hereinafter “Participant(s)”).
2. The duration of the Promo is from 30/10/2024, 10:00:00, to 20/12/2024, 22:59:59 (hereinafter the “Duration”).
3. Coupons can be redeemed from 30/10/2024, 00:00:01, to 31/12/2024, 23:59:59. Once the above date has elapsed, the Coupon is deactivated and cannot be redeemed or replaced.
4. The Coupon is available within the “WHAT’S UP” application by OTE, in the “Exclusive Offers” section under the option “10€ payzy coupon with registration,” which the Participant can redeem after completing their registration in the App within the Duration specified in paragraph 2. Redemption is available only once, exclusively within the App, in the “Earn with payzy” -> Coupons section and within the time frame specified in paragraph 3. Specifically, by entering the unique Coupon code, the Participant will immediately receive one thousand (1,000) Coins, equivalent to ten (10) euros, which can be redeemed at any time in their Wallet via the “Coins” section.
5. Each Coupon is strictly for the personal use of the Participant, and COSMOTE Payments is not liable for replacing or obliged to replace or cancel it in the event of its theft or loss or use by a third party (see terms here).
6. Participants must act legally and within the framework of fair dealing and these Terms. If any action or behavior of any Participant is deemed by COSMOTE Payments to be illegal, abusive, or non-contractual, then the Organiser has the right, among other things, to disqualify the Participant from the Promo and to cancel the Coupon.
7. During the Promo, the Organiser reserves the right to amend and/or revoke it, change the dates on which it will be held or any other of its terms, informing the Participants by any means it deems appropriate (e.g. by e-mail or push notification or text message or via its website or via its App).
8. The Organiser shall bear no liability towards the Participants and/or any third party for any direct or indirect damages, costs, and expenses that may arise from any interruption, malfunction, delay, or any other cause related to the implementation of the Promo.
9. The data controller is the Organiser, namely the société anonyme with the trade name ‘COSMOTE PAYMENTS – E-MONEY SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME’, with its headquarters in Marousi, Attica (99 Kifissias Ave.).
The following personal data of the Participants shall be collected and processed in order for them to participate in the Promo:
- Date and time of registration
- The mobile telephone number declared upon registration
- The registration e-mail address
10. The data is collected for the purpose of carrying out the Promo in accordance with these Terms and to serve the contract concluded between the Participants and COSMOTE Payments, based on which the Participants maintain an account with COSMOTE Payments, in accordance with the terms of the General Information regarding Personal Data Protection, which you can find here. Under these terms, the personal data collected are retained for a period of five (5) years from the date of expiry of the business relationship and the submission of the relevant identification application. Upon expiry of this deadline, the data shall be deleted, unless another provision of law or regulatory act requires them to be stored for a longer period, which cannot exceed ten (10) years (e.g. for tax purposes).
The following third companies are also recipients of the Promo Participants’ personal data:
- NEXI GREECE PROCESSING SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME, which provides payment processing and card issuing services and has its registered office in Greece.
- NETCOMPANY-INTRASOFT S.A., which provides and supports the operation of COSMOTE Payments' banking systems and has its registered office in Greece.
- Cognity S.A., which supports the operation of the Application and has its registered office in Greece,
These third companies are processors on behalf of COSMOTE Payments – in other words, they are partners of COSMOTE Payments – who undertake the execution of a specific project following its instructions and applying the strict procedures of OTE Group regarding the processing of personal data. COSMOTE Payments remains liable with regard to the processing of personal data carried out by its partners. The processing of personal data for the above purposes by COSMOTE Payments’ partners takes place mainly in Greece and the European Union (EU).
11. Beyond the above-mentioned companies, COSMOTE Payments does not process or disclose personal data to third parties, with the exception of cases where their communication/transmission is required by the applicable laws.
12. Participants have the following rights regarding the processing of their personal data:
• Right of access: the right to receive information about the personal data subject to processing (e.g. the purposes of processing, the types of data, the recipients to whom they are communicated, the period for which they are retained) and to be provided copies thereof.
• Right to rectification: the right to request the correction of their data (e.g. correction of contact details).
• Right to erasure: the right to request the deletion of their personal data if they are no longer necessary in relation to the purposes for which they were processed or if they withdraw their consent.
• Right to restriction of processing: the right to request the restriction of processing for a specific purpose.
• Right to object: the right to object, in cases in which they do not want their personal data to be processed.
13. The Organiser has appointed a Data Protection Officer (DPO) based on the provisions of the applicable legislation. To contact the Data Protection Officer, Participants may send an e-mail to customerprivacy@cosmotepayments.gr .
In order to exercise their rights, Participants may send:
a. an e-mail to customerprivacy@cosmotepayments.gr or
b. a fax to +30 2102511888 or
c. a letter to COSMOTE Payments Customer Service, 99 Kifissias Ave., 15124, Marousi, on “Exercise of Rights to Personal Data”
stating their full name and their mobile telephone or landline connection number.
14. Participants retain the right to lodge a complaint via a special web portal to the Hellenic Data Protection Authority (Athens, 1-3 Kifissias Avenue, 115 23 | tel. +30 210 6475600). Detailed instructions for submitting a complaint are provided on the Authority’s website.
The Organiser shall respond to the requests free of charge without delay, within one (1) month from the receipt of the request. In exceptional cases, this deadline may be extended by two (2) months, if the complexity of the request so requires. In any case, the Organiser shall make notification regarding this extension and the reason for the delay. If it is found that the request is clearly unfounded or excessive, the Organiser reserves the right to request payment of a reasonable fee to its satisfaction, taking into account the administrative costs for its execution, or even to refuse to follow up the request.
15. The Organiser shall take appropriate organisational and technical measures to secure the data and protect them from accidental or unlawful destruction, accidental loss, alteration, prohibited dissemination or access, and any other form of unlawful processing.
16. The Organiser shall not be liable for leaks of the Participants’ personal data due to their disclosure of any of their data via third-party or other internet sites.
17. Participation in the Promo requires and implies the explicit and unreserved acceptance of all these Terms. Furthermore, COSMOTE Payments shall not be liable for any damage that may result in the temporary or permanent cessation of the Promo.
18. These Terms are governed by Greek law and any dispute as to their interpretation and/or application shall be resolved exclusively by the courts of Athens, with express prorogation of any other local jurisdiction.
