The société anonyme under the name ‘COSMOTE PAYMENTS - E-MONEY SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME’, (hereinafter “COSMOTE Payments” or the “Organiser”), with its headquarters in Marousi, Attica, (No 99 Kifissias Avenue), is organising a promotional action ‘20% payzy cashback for every first QR payment at payzy pro spots’ (hereinafter the “Promo”), which rewards users of ‘payzy by COSMOTE’ (hereinafter the “App”) for purchases of products and/or services by scanning the Quick Response Bar Code (hereinafter the “QR Code”) from the affiliated businesses mentioned in the ‘payzy pro spots’ Section of the App (hereinafter “Affiliated Business/Businesses”).
The purpose of these terms (hereinafter the “Terms”) is to define the terms of participation in the Promo.
1. All permanent residents of Greece who are legally competent and who are at least 18 years old and have a payment account with COSMOTE Payments (hereinafter, "Participants") in their name are eligible to participate in the Promo.
2. The duration of the Promo is from 14/05/2024, 00:00:01, to 30/06/2024, 22:59:59 (hereinafter “Duration”).
3. Participants in each first transaction made via QR Code at any of the Partnering Businesses they haven't previously visited and paid via QR code, will receive within the Duration twentyfold (X20) the value of the transaction in Coins, equivalent to 20% of the transaction value in euros. Furthermore, for each subsequent transaction made via QR Code at the same Partnering Business within the Duration, they will receive fivefold (X5) the value of the transaction in Coins, equivalent to 5% of the transaction value in euros, in accordance with the terms of the Loyalty Program 'Coins' described here.
4. The maximum amount in Coins that a Participant may receive for the first (1st) transaction they carry out via QR Code in the context of the Promo is set at ten thousand (10,000) Coins, which corresponds to the amount of one hundred (100) Euros per Affiliated Business. For each subsequent transaction the Participant carries out at an Affiliated Business, there is no maximum number of Coins awarded.
5. The Promo is only valid for payments made via QR Code through the App and not in any other way (e.g., payment using the Application’s digital or physical card), irrespective of the amount per transaction.
6. The Coins that Participants will receive, via payment by QR code, will be stored in the ‘Coins’ section of the App.
7. Coins will be issued automatically upon successful receipt by COSMOTE Payments of each payment order, and they can be redeemed in Euros from Participants’ wallets, any time they choose.
8. The Organiser shall bear no liability towards the Participants and/or any third party for any direct or indirect damages, costs, or expenses that may arise from any interruption, malfunction, delay, or any other cause related to the implementation of the Promo.
9. The data controller is the Organiser, namely the société anonyme with the trade name ‘COSMOTE PAYMENTS – E-MONEY SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME’.
The following personal data of the Participants shall be collected and processed so that they can participate in the Promo:
- The date and time of execution of the payment transaction via the QR Code.
- Total amount paid via QR Code.
- The COSMOTE Payments account number.
In addition, the following personal data of the Affiliated Businesses shall be collected and processed for participation in the Promo:
- Name of the Affiliated Business where the payment transaction via QR Code was made.
- The COSMOTE Payments account number.
The data is collected for the purpose of carrying out the Promo in accordance with these Terms and to serve the contract concluded between the Participants and COSMOTE Payments, based on which the Participants maintain a payment account with COSMOTE Payments to execute payments via QR Code, in accordance with the terms of the General Information regarding Personal Data Protection, which you can find here. Under these terms, the personal data collected are retained for a period of five (5) years from the date of execution of the payment transaction. Upon expiry of this deadline, the data shall be deleted, unless another provision of law or regulatory act requires them to be stored for a longer period, which cannot exceed ten (10) years (e.g. for tax purposes).
The following third companies are also recipients of the Promo Participants’ personal data:
- NEXI GREECE PROCESSING SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME, which provides payment processing and card issuing services and has its registered office in Greece.
- NETCOMPANY-INTRASOFT S.A., which provides and supports the operation of COSMOTE Payments' banking systems and has its registered office in Greece.
- Cognity S.A., which supports the operation of the payzy by COSMOTE application and has its registered office in Greece,
These third companies are processors on behalf of COSMOTE Payments – in other words, they are partners of COSMOTE Payments – who undertake the execution of a specific project following the instructions of COSMOTE Payments and applying the strict procedures of OTE Group regarding the processing of the Participants’ personal data. COSMOTE Payments remains liable with regard to the processing of personal data carried out by its partners. The processing of Participants’ personal data for the above purposes by COSMOTE Payments’ partners takes place mainly in Greece and the European Union (EU).
10. Beyond the above-mentioned companies, COSMOTE Payments does not process or disclose personal data to third parties, with the exception of cases where their communication/transmission is required by the applicable laws.
11. Participants have the following rights regarding the processing of their personal data:
• Right of access: the right to receive information about the personal data subject to processing (e.g. the purposes of processing, the types of data, the recipients to whom they are communicated, the period for which they are retained) and to be provided copies thereof.
• Right to rectification: the right to request the correction of their data (e.g. correction of contact details).
• Right to erasure: the right to request the deletion of their personal data if they are no longer necessary in relation to the purposes for which they were processed or if they withdraw their consent.
• Right to restriction of processing: the right to request the restriction of processing for a specific purpose.
• Right to object to processing of their personal data in cases in which they do not want their personal data to be processed.
12. The Organiser has appointed a Data Protection Officer (DPO) based on the provisions of the applicable legislation. To contact the Data Protection Officer, Participants may send an e-mail to customerprivacy@cosmotepayments.gr.
In order to exercise their rights, Participants may send:
a. an e-mail to customerprivacy@cosmotepayments.gr or
b. a fax to +30 2102511888 or
c. a letter to COSMOTE Payments Customer Service, No 99 Kifissias Ave., GR-15124, Marousi
on the subject of ‘Exercising of personal data rights’, stating their full name and their mobile telephone or landline connection number.
Participants reserve the right to lodge a complaint via a special web portal to the Hellenic Data Protection Authority (Athens, Nos 1-3 Kifissias Avenue, GR-115 23 | tel. No +30 210 6475600). Detailed instructions for submitting a complaint are provided on the Authority’s website.
The Organiser shall respond to the requests free of charge without delay, within one (1) month from the receipt of the request. In exceptional cases, this deadline may be extended by two (2) months, if the complexity of the request so requires. In any case, the Organiser shall make notification regarding this extension and the reason for the delay.
If it is found that the request is clearly unfounded or excessive, the Organiser reserves the right to request payment of a reasonable fee for its satisfaction, taking into account the administrative costs for its execution or even to refuse to follow up the request.
13. The Organiser shall take appropriate organisational and technical measures to secure the data and protect them from accidental or unlawful destruction, accidental loss, alteration, prohibited dissemination or access, and any other form of unlawful processing.
14. The Organiser shall not be liable for leaks of the Participants’ personal data due to their disclosure of any of their data via third-party or other internet sites.
15. During the Promo, the Organiser reserves the right to amend and/or revoke it, change the dates on which it will be held or any other of its terms or amend the amount of Coins collected per payment and the method by which they are provided, informing Participants by any appropriate means (e.g. by email or push notification or text message).
16. Participation in the Promo requires and implies the explicit and unreserved acceptance of all these Terms. Furthermore, the Organiser shall not be liable for any malfunction that may result in the temporary or permanent cessation of the Promo.
17. These Terms are governed by Greek law and any dispute as to their interpretation and/or application shall be resolved exclusively by the courts of Athens, with express prorogation of any other local jurisdiction.
