The société anonyme with the trade name ‘COSMOTE PAYMENTS - E-MONEY SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME’ (hereinafter “COSMOTE Payments” or the “Organiser”), with its headquarters in Marousi, Attica, (No 99 Kifissias Avenue), is organising the promotional action titled ‘Registration Gift - €40 gift voucher’ (hereinafter the “Promo”), in the framework of which those registering for the ‘payzy by COSMOTE’ App (hereinafter the “Application”) shall be rewarded with a €40 gift voucher to be redeemed with product purchases exclusively at the physical stores of the ‘GERMANOS ELECTRONICS - TELECOMMUNICATIONS HARDWARE AND TELECOMMUNICATION SERVICES INDUSTRIAL & COMMERCIAL S.A.’, ‘COSMOTE - MOBILE TELECOMMUNICATIONS SINGLE-PERSON S.A.’, and ‘HELLENIC TELECOMMUNICATIONS ORGANIZATION S.A.’ companies, as well as the stores of their commercial partners (licensees) that use the GERMANOS or COSMOTE trademark (hereinafter the “Stores”).
The purpose of these terms (hereinafter the “Terms”) is to define the terms of participation in the Promo.
1. All permanent residents of Greece who are legally competent and who are at least 18 years old and have not registered with the Application so far (hereinafter the “Participants”), are eligible to participate in the Promo.
2. The duration of the Promo is from 04/12/2023, 00:00:01, to 16/12/2023, at 22:59:59, or until gift vouchers are exhausted, whichever is earlier.
3. Participants who complete their Application registration (including their identification - verification procedure) within the above duration, according to COSMOTE Payments E-Wallet Terms of Use (see terms here), will immediately receive, in electronic form, a unique gift voucher code worth forty (40) Euros (hereinafter the “Gift Voucher”) via e-mail and text message at the e-mail address and mobile telephone number they provided to COSMOTE Payments upon registration.
4. The Gift Voucher shall be provided exclusively to the Participant registering for the 1st time with the Application, within the above duration of the Promo.
5. The Participant may redeem the Gift Voucher exclusively at Stores until 31/01/2024. Once the above date has elapsed, the Gift Voucher is deactivated and cannot be redeemed or replaced.
6. Each Gift Voucher is redeemed in a single transaction and exclusively for purchases made at Stores. Gift Vouchers do not apply to online purchases, even if the option to pick up the product(s) at the Stores has been selected. Gift vouchers cannot be redeemed for cash or services, such as, indicatively, payment of bills, payment of guarantees, service, topping up (paperless top-up or voucher), etc.
7. If the value of the transaction is less than the value of the Gift Voucher, the balance of its value is lost and no cash refund is made. If the value of the transaction is greater than the value of the Gift Voucher, then the Participant shall be required to settle the resulting difference.
8. The Gift Voucher is deducted from the final value of the transaction and may be used by the Participant at Stores in combination with any other offer and/or promo and/or discount and/or discount reward plan cards and/or coupons and/or device subsidy.
9. The Gift Voucher is for strictly personal use and may not be transferred to any third party.
10. In case of theft or loss, the Gift Voucher shall not be replaced, cancelled, or its value in any way reimbursed, and the Organiser and/or the Stores shall bear no liability whatsoever.
11. Participants must act legally and within the framework of fair dealing and these terms. If any action or behaviour of any Participant is deemed by COSMOTE Payments to be illegal, abusive, or non-contractual, then it has the right, among other things, to disqualify that Participant from the Promo and to cancel the Gift Voucher.
12. During the Promo, the Organiser reserves the right to amend and/or revoke it, change the dates on which it will be held or any other of its terms, informing the Participant by any means it deems appropriate (e.g. via its website).
13. The Organiser shall bear no liability towards the Participants and/or any third party for any direct or indirect damages, costs, and expenses that may arise from any interruption, malfunction, delay, or any other cause related to the implementation of the Promo.
14. The data controller is the Organiser, namely the société anonyme with the trade name ‘COSMOTE PAYMENTS – E-MONEY SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME’, with its headquarters in Marousi, Attica, (No 99 Kifissias Avenue).
The following personal data of the Participants shall be collected and processed in order to participate in the Promo:
- Registration date and time
- Mobile telephone number declared upon registration
- Registration e-mail address
15. The data is collected for the purpose of carrying out the Promo in accordance with these Terms and to serve the contract concluded between the Participants and COSMOTE Payments, based on which the Participants maintain an account with COSMOTE Payments, in accordance with the terms of the General Information regarding Personal Data Protection, which you can find here. Under these terms, the personal data collected are retained for a period of five (5) years from the date of expiry of the business relationship and the submission of the relevant identification application. Upon expiry of this deadline, the data shall be deleted, unless another provision of law or regulatory act requires them to be stored for a longer period, which cannot exceed ten (10) years (e.g. for tax purposes).
The following third companies are also recipients of the Promo Participants’ personal data:
- NEXI GREECE PROCESSING SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME, which provides payment processing and card issuing services and has its registered office in Greece.
- NETCOMPANY-INTRASOFT S.A., which provides and supports the operation of COSMOTE Payments' banking systems and has its registered office in Greece.
- Cognity S.A., which supports the operation of the Application and has its registered office in Greece,
These third companies are processors on behalf of COSMOTE Payments – in other words, they are partners of COSMOTE Payments – who undertake the execution of a specific project following its instructions and applying the strict procedures of OTE Group regarding the processing of personal data. COSMOTE Payments remains liable with regard to the processing of personal data carried out by its partners. The processing of personal data for the above purposes by COSMOTE Payments’ partners takes place mainly in Greece and the European Union (EU).
16. Beyond the above-mentioned companies, COSMOTE Payments does not process or disclose personal data to third parties, with the exception of cases where their communication/transmission is required by the applicable laws.
17. Participants have the following rights regarding the processing of their personal data:
• Right of access: the right to receive information about the personal data subject to processing (e.g. the purposes of processing, the types of data, the recipients to whom they are communicated, the period for which they are retained) and to be provided copies thereof.
• Right to rectification: the right to request the correction of their data (e.g. correction of contact details).
• Right to erasure: the right to request the deletion of their personal data if they are no longer necessary in relation to the purposes for which they were processed or if they withdraw their consent.
• Right to restriction of processing: the right to request the restriction of processing for a specific purpose.
• Right to object: the right to object, in cases in which they do not want their personal data to be processed.
18. The Organiser has appointed a Data Protection Officer (DPO) based on the provisions of the applicable legislation. To contact the Data Protection Officer, Participants may send an e-mail to customerprivacy@cosmotepayments.gr .
In order to exercise their rights, Participants may send:
a. an e-mail to customerprivacy@cosmotepayments.gr or
b. a fax to +30 2102511888 or
c. a letter to COSMOTE Payments Customer Service, No 99 Kifissias Ave., GR-15124, Marousi, regarding ‘Exercising of Personal Data Rights’, stating their full name and their mobile telephone or landline connection number.
19. Participants reserve the right to lodge a complaint via a special web portal to the Hellenic Data Protection Authority (Athens, Nos 1-3 Kifissias Avenue, GR-115 23 | tel. No +30 210 6475600). Detailed instructions for submitting a complaint are provided on the Authority’s website.
The Organiser shall respond to the requests free of charge without delay, within one (1) month from the receipt of the request. In exceptional cases, this deadline may be extended by two (2) months, if the complexity of the request so requires. In any case, the Organiser shall make notification regarding this extension and the reason for the delay. If it is found that the request is clearly unfounded or excessive, the Organiser reserves the right to request payment of a reasonable fee to its satisfaction, taking into account the administrative costs for its execution or even to refuse to follow up the request.
20. The Organiser shall take appropriate organisational and technical measures to secure the data and protect them from accidental or unlawful destruction, accidental loss, alteration, prohibited dissemination or access, and any other form of unlawful processing.
21. The Organiser shall not be liable for leaks of the Participants’ personal data due to their disclosure of any of their data via third-party or other internet sites.
22. Participation in the Promo requires and implies the explicit and unreserved acceptance of all these Terms. Furthermore, COSMOTE Payments shall not be liable for any damage that may result in the temporary or permanent cessation of the Promo.
23. These Terms are governed by Greek law and any dispute as to their interpretation and/or application shall be resolved exclusively by the courts of Athens, with express prorogation of any other local jurisdiction.
