The société anonyme with the trade name ‘COSMOTE PAYMENTS - E-MONEY SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME’ (hereinafter “COSMOTE Payments” or the “Organiser”), with its headquarters in Marousi, Attica, (No 99 Kifissias Avenue), is organising in collaboration with “GERMANOS ELECTRONICS - TELECOMMUNICATIONS HARDWARE AND TELECOMMUNICATION SERVICES INDUSTRIAL & COMMERCIAL S.A.” (hereinafter the “Company”), with its headquarters in Marousi, Attica, (No 99 Kifissias Avenue), a promotional action titled “10% payzy cashback at COSMOTE Glyfada store” (hereinafter “Promo”), which rewards COSMOTE Payments payment card holders for purchases of products exclusively at the physical COSMOTE store in Glyfada, at 65 Poseidonos Av. & 2 Vasos Katrakis Square (hereinafter the “Physical Store”).
The purpose of these terms (hereinafter “Terms”) is to define the terms of participation in the Promo.
1. All permanent residents of Greece, qualified for legal acts, who are 18 years old, have a payment account with COSMOTE Payments in their name, and are holders of the virtual and/or physical payzy by COSMOTE VISA debit card (hereinafter “Card”) that is/are connected to the above payment account (hereinafter the “Participant(s)”) are eligible to participate in the Promo.
2. The Promo will take place at the Physical Store exclusively on the following days and times:
• 27/06/2023, from 17:00 PM to 21:00 PM
• 29/06/2023, from 17:00 PM to 21:00 PM
• 30/06/2023, from 17:00 PM to 21:00 PM
3. The Promo is exclusively valid for purchase(s) of product(s) from the Physical Store using the Card, irrespective of the amount per transaction.
4. The Participant shall receive an amount in Euros to their payment account with COSMOTE Payments (“Cashback”) corresponding to 10% of the final value of the transaction, which has been paid using the Card.
5. The Promo exclusively concerns payment transactions carried out directly with the Card, via the Physical Store’s physical POS, for full payment of the price, on the days and at the hours that the Promo is valid, as defined in Paragraph 2.
6. The maximum amount of Cashback that can be credited to the Participant’s payment account per Card under the Promo is 200€, irrespective of the amount and the number of transactions that the Participant carries out.
7. The Promo excludes the payment of bills of any kind and the renewal of talk time.
8. The Participant, in the context of the “Coins” Loyalty Programme, the terms of which are described in the Terms of Use of the “payzy by COSMOTE” App, will collect as many Coins as the amount of the transaction that has been paid using the Card and which are equal to an additional 1% redemption in Euros to their payment account at COSMOTE Payments.
9. Cashback will be paid once each payment transaction made with the Card has been cleared.
10. COSMOTE Payments shall bear no liability towards the Participants and/or any third party for any direct or indirect damages, costs, and expenses that may arise from any interruption, malfunction, delay, or any other cause related to the implementation of the Promo.
11. COSMOTE Payments’ liability is strictly limited to paying the Cashback. COSMOTE Payments bears no further liability, nor is it involved in or does it intervene in any problem that may arise with the Company’s products, for which the latter is solely liable.
12. The data controller is the Organiser, namely the société anonyme with the trade name ‘COSMOTE PAYMENTS – E-MONEY SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME’, with its headquarters in Marousi, Attica, (No 99 Kifissias Avenue).
The following personal data of the Participants shall be collected and processed in order to participate in the Promo:
- The details of the Card used in the payment for the purchase of products exclusively from the Physical Store.
- The date and time of execution of the payment for the purchase of products exclusively from the Physical Store.
- The total amount paid using the Card to purchase products from the Physical Store.
- The COSMOTE Payments payment account number.
The data is collected for the purpose of carrying out the Promo in accordance with these terms and to serve the contract concluded between the Participants and COSMOTE Payments, based on which the Participants maintain a payment account with COSMOTE Payments and lawfully hold a Card or Cards that are connected to the above payment account and use said Card or Cards as a means of payment of the price of their transactions with the Company, in accordance with the terms of the General Information regarding Personal Data Protection, that you can find here. Under these terms, the personal data collected are retained for a period of five (5) years from the date of execution of the payment transaction. Upon expiry of this deadline, the data shall be deleted, unless another provision of law or regulatory act requires them to be stored for a longer period, which cannot exceed ten (10) years (e.g. for tax purposes).
The following third companies are also recipients of the Promo Participants’ personal data:
- NEXI GREECE PROCESSING SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME, which provides payment processing and card issuing services and has its registered office in Greece.
- NETCOMPANY-INTRASOFT S.A., which provides and supports the operation of COSMOTE Payments' banking systems and has its registered office in Greece.
- Cognity S.A., which supports the operation of the payzy by COSMOTE application and has its registered office in Greece,
These third companies are processors on behalf of COSMOTE Payments – in other words, they are partners of COSMOTE Payments – who undertake the execution of a specific project following the instructions of COSMOTE Payments and applying the strict procedures of the OTE Group regarding the processing of the Participants’ personal data. COSMOTE Payments remains liable with regard to the processing of personal data carried out by its partners. The processing of Participants’ personal data for the above purposes by COSMOTE Payments’ partners takes place mainly in Greece and the European Union (EU).
13. Beyond to the above-mentioned companies, COSMOTE Payments does not process or disclose personal data to third parties, with the exception of cases where their communication/transmission is required by the applicable laws.
14. Participants have the following rights regarding the processing of their personal data:
• Right of access: the right to receive information about the personal data subject to processing (e.g. the purposes of processing, the types of data, the recipients to whom they are communicated, the period for which they are retained) and to be provided copies thereof.
• Right to rectification: the right to request the correction of their data (e.g. correction of contact details).
• Right to erasure: the right to request the deletion of their personal data if they are no longer necessary in relation to the purposes for which they were processed or if they withdraw their consent.
• Right to restriction of processing: the right to request the restriction of processing for a specific purpose.
• Right to object to processing of their personal data in cases in which they do not want their personal data to be processed.
15. The Organiser has appointed a Data Privacy Officer (DPO) based on the provisions of the applicable legislation. To contact the Data Protection Officer, Participants may send an e-mail to customerprivacy@cosmotepayments.gr.
In order to exercise their rights, Participants may send:
a. an e-mail to customerprivacy@cosmotepayments.gr, or
b. a fax to +30 2102511888 or
c. a letter to COSMOTE Payments Customer Service, No 99 Kifissias Ave., GR-15124, Marousi, regarding ‘Exercising of Personal Data Rights’ stating their full name and their mobile telephone or landline connection number.
16. Participants reserve the right to lodge a complaint, via a special web portal, with the Hellenic Data Protection Authority (Athens, Nos 1-3 Kifissias Avenue, GR-115 23 | tel. No +30 210 6475600). Detailed instructions for submitting a complaint are provided on the Authority’s website.
The Organiser shall respond to the requests free of charge without delay, within one (1) month from the receipt of the request. In exceptional cases, this deadline may be extended by two (2) months, if the complexity of the request so requires. In any case, the Organiser shall inform regarding this extension and the reason for the delay.
If it is found that the request is clearly unfounded or excessive, the Organiser reserves the right to request payment of a reasonable fee to its satisfaction, taking into account the administrative costs for its execution or even to refuse to follow up the request.
17. The Organiser shall take appropriate organisational and technical measures to secure the data and protect them from accidental or unlawful destruction, accidental loss, alteration, prohibited dissemination or access, and any other form of unlawful processing.
18. The Organiser shall not be liable for leaks of the Participants’ personal data due to their disclosure of any of their data via third-party or other internet sites.
19. The Terms shall continue to bind Participants even after its expiry and for as long as the right of access to the content is retained, in accordance with the above.
20. During the Promo, the Organiser reserves the right to amend and/or revoke it, change the dates on which it will be held or any other of its terms, change or amend the percentage of Cashback and its method of payment, informing Participants by any appropriate means (e.g. by e-mail or push notification or text message).
21. Participation in the Promo requires and implies the explicit and unreserved acceptance of all these Terms. Furthermore, the Organiser shall not be liable for any malfunction that may result in the temporary or permanent cessation of the Promo.
22. These Terms are governed by Greek law and any dispute as to their interpretation and/or application shall be resolved exclusively by the courts of Athens, with express prorogation of any other local jurisdiction.
