The société anonyme with the trade name ‘COSMOTE PAYMENTS - E-MONEY SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME’ (hereinafter “COSMOTE Payments” or the “Organiser”), with its headquarters in Marousi, Attica, (No 99 Kifissias Avenue), is organising a Promotional Action (hereinafter the “Promo”) for the subscribers of ‘What’s Up’ by ‘COSMOTE MOBILE TELECOMMUNICATIONS SINGLE-MEMBER SOCIÉTÉ ANONYME’, (hereinafter “COSMOTE S.A.”) registering for the first time with the “payzy by COSMOTE” App (hereinafter the “Application”).
The purpose of these terms (hereinafter “Terms”) is to define the terms of participation in the Promo.
1. All permanent residents of Greece, qualified for legal acts, who are 18 years old, and are subscribed to ‘What’s Up’ mobile telephony services (prepaid and cost-control) and have not registered with the Application so far (hereinafter the “participants”) are eligible to participate in the Promo.
2. The duration of the Promo is from 12/06/2023, at 00.00.01, until 16/06/2023, at 23.59.59.
3. Participants who initiate and successfully complete their Application registration (including their identification - verification procedure) within the above duration, according to COSMOTE Payments E-Wallet Terms of Use (see terms here), will immediately receive one thousand (1,000) Coins, which correspond to the sum of ten (10) Euros.
4. For the awarding of the 1,000 Coin reward, participants must give their consent upon registration with the App for their What’s Up mobile phone number, with which they registered with the App, to be sent to COSMOTE S.A.
5. The 1,000 Coin reward shall be exclusively awarded to participants who register with the Application using a What’s Up mobile telephone number and provided they have given their consent, in accordance with term 4 above.
6. The 1,000 Coin reward, corresponding to the sum of 10 Euros, shall be stored in the ‘Coins’ section of the Application and Participants may redeem them at any time in their Wallet.
7. COSMOTE Payments reserves the right to discontinue or extend the Promo by notifying participants in any appropriate manner via the What’s Up app (e.g. announcement and/or notification in the app).
8. COSMOTE Payments shall bear no liability towards the participants and/or any third party for any direct or indirect damages, costs, and expenses that may arise from any interruption, malfunction, delay, or any other cause related to the implementation of the Promo.
9. The data controller is the Organiser, namely the société anonyme with the trade name ‘COSMOTE PAYMENTS – E-MONEY SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME’, with its headquarters in Marousi, Attica, (No 99 Kifissias Avenue).
The following personal data of the participants shall be collected and processed in order to participate in the Promo:
- Registration date and time
- Mobile telephone number declared upon registration
- ID of member/registered App user
10. The data is collected for the purpose of carrying out the Promo in accordance with these terms and to serve the contract concluded between the Holders and COSMOTE Payments, based on which the Holders maintain a payment account with COSMOTE Payments and lawfully hold a Card or Cards that are connected to the above payment account and use said Card or Cards as a means of payment of the price of their transactions with the Company, in accordance with the terms of the General Information regarding Personal Data Protection, that you can find here. Under these terms, the personal data collected are retained for a period of five (5) years from the date of execution of the payment transaction. Upon expiry of this deadline, the data shall be deleted, unless another provision of law or regulatory act requires them to be stored for a longer period, which cannot exceed ten (10) years (e.g. for tax purposes).
The following third companies are also recipients of the Promo Participants’ personal data:
- NEXI GREECE PROCESSING SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME, which provides payment processing and card issuing services and has its registered office in Greece.
- NETCOMPANY-INTRASOFT S.A., which provides and supports the operation of COSMOTE Payments' banking systems and has its registered office in Greece.
- Cognity S.A., which supports the operation of the payzy by COSMOTE application and has its registered office in Greece.
These third companies are processors on behalf of COSMOTE Payments – in other words, they are partners of COSMOTE Payments – who undertake the execution of a specific project following the instructions of COSMOTE Payments and applying the strict procedures of the OTE Group regarding the processing of the participants’ personal data. COSMOTE Payments remains liable with regard to the processing of personal data carried out by its partners. The processing of participants’ personal data for the above purposes by COSMOTE Payments’ partners takes place mainly in Greece and the European Union (EU).
11. Beyond to the above-mentioned companies, COSMOTE Payments does not process or disclose personal data to third parties, with the exception of cases where their communication/transmission is required by the applicable laws.
12. Participants have the following rights regarding the processing of their personal data:
• Right of access: the right to receive information about the personal data subject to processing (e.g. the purposes of processing, the types of data, the recipients to whom they are communicated, the period for which they are retained) and to be provided copies thereof.
• Right to rectification: the right to request the correction of their data (e.g. correction of contact details).
• Right to erasure: the right to request the deletion of their personal data if they are no longer necessary in relation to the purposes for which they were processed or if they withdraw their consent.
• Right to restriction of processing: the right to request the restriction of processing for a specific purpose.
• Right to object to processing of their personal data in cases in which they do not want their personal data to be processed.
13. The Organiser has appointed a Data Privacy Officer (DPO) based on the provisions of the applicable legislation. To contact the Data Protection Officer, participants may send an e-mail to customerprivacy@cosmotepayments.gr.
In order to exercise their rights, participants may send:
a. an e-mail to customerprivacy@cosmotepayments.gr , or
b. a fax to +30 2102511888 or
c. a letter to COSMOTE Payments Customer Service, No 99 Kifissias Ave., GR-15124, Marousi, regarding ‘Exercising of Personal Data Rights’, stating their full name and their mobile telephone or landline connection number.
14. Participants reserve the right to lodge a complaint, via a special web portal, with the Hellenic Data Protection Authority (Athens, Nos 1-3 Kifissias Avenue, GR-115 23 | tel. No +30 210 6475600). Detailed instructions for submitting a complaint are provided on the Authority’s website.
The Organiser shall respond to the requests free of charge without delay, within one (1) month from the receipt of the request. In exceptional cases, this deadline may be extended by two (2) months, if the complexity of the request so requires. In any case, the Organiser shall make notification regarding this extension and the reason for the delay. If it is found that the request is clearly unfounded or excessive, the Organiser reserves the right to request payment of a reasonable fee to its satisfaction, taking into account the administrative costs for its execution or even to refuse to follow up the request.
15. The Organiser shall take appropriate organisational and technical measures to secure the data and protect them from accidental or unlawful destruction, accidental loss, alteration, prohibited dissemination or access, and any other form of unlawful processing.
16. The Organiser shall not be liable for leaks of the participants’ personal data due to their disclosure of any of their data via third-party or other internet sites.
17. Participation in the Promo requires and implies the explicit and unreserved acceptance of all these terms. Furthermore, COSMOTE Payments shall not be liable for any malfunction that may result in the temporary or permanent cessation of the Promo.
18. These terms are governed by Greek law and any dispute as to their interpretation and/or application shall be resolved exclusively by the courts of Athens, with express prorogation of any other local jurisdiction.
